Terms and Conditions

These Terms and Conditions govern your access to and use of www.sur.art, including artwork inquiries and transactions facilitated through the website.


SUR is an independent art platform operating under the name “SUR” from Jordan.


References to “SUR,” “we,” “us,” and “our” refer to the operators of the SUR platform.


References to “you” and “your” refer to the visitor, collector, prospective buyer, or customer using the website.


By accessing the website, submitting an inquiry, or proceeding with an artwork transaction facilitated by SUR, you agree to these Terms and Conditions.


1. About SUR

SUR is an independent art platform that presents and promotes artworks and facilitates communication between artists, artwork owners, authorised sellers, collectors, and prospective buyers.

SUR may assist with:

  • Artwork promotion

  • Artwork inquiries

  • Communication between buyers and artists

  • Price confirmation

  • Availability confirmation

  • Payment coordination

  • Delivery or collection arrangements

  • General transaction administration

Unless expressly stated otherwise, SUR is not the owner or seller of the artworks displayed on the website.


2. Status of SUR

SUR currently operates as an independent art platform from Jordan and is not presented as an incorporated company.

The name “SUR” is used as the platform name through which the website and related activities are conducted.

Nothing on the website should be interpreted as a claim that SUR holds a company registration, gallery licence, professional accreditation, or other formal status that has not expressly been stated.

SUR may update its legal or operational structure in the future.

Any such change will not affect transactions already confirmed unless otherwise communicated and agreed.


3. SUR’s Role

Unless expressly confirmed otherwise in writing, SUR:

  • Does not own the artworks displayed on the website

  • Is not the seller of the artwork

  • Does not receive or hold the buyer’s purchase payment

  • Is not a bank, payment processor, or escrow provider

  • Does not automatically enter into a sales agreement with the buyer

  • Does not have authority to bind an artist or seller before the artist or seller confirms the transaction

The artist, artwork owner, or authorised representative identified in the transaction confirmation is the seller of the artwork and is referred to in these Terms as the “Artist” or “Seller.”

The contract for the purchase of an artwork is made directly between the Buyer and the Artist or Seller.

SUR facilitates the transaction but is not a party to the sales contract unless SUR expressly confirms otherwise in writing for a particular transaction.


4. Website Technology

The website is built and hosted using Odoo technology and was designed and developed by Zumra.

Odoo and Zumra provide website infrastructure, design, development, maintenance, or technical support only.

Odoo and Zumra are not:

  • The artist

  • The seller

  • The buyer

  • The artwork owner

  • The payment recipient

  • The delivery provider

  • Parties to an artwork transaction

Neither Odoo nor Zumra is responsible for artwork availability, ownership, descriptions, pricing, payments, delivery, returns, refunds, authenticity, or disputes between buyers and sellers.


5. Artwork Listings

Artwork listings on the website are provided for information and invitation-to-inquire purposes.

A listing does not constitute a binding offer for sale.

Displaying an artwork on the website does not guarantee that:

  • The artwork remains available

  • The price remains unchanged

  • The artist will accept an offer

  • The artwork is reserved

  • The transaction can be completed in the buyer’s location

All artworks are subject to confirmation by the relevant Artist or Seller.


6. Artwork Information

SUR makes reasonable efforts to present accurate information about artworks, including:

  • Artist name

  • Artwork title

  • Medium

  • Materials

  • Dimensions

  • Edition details

  • Availability

  • Price or price-on-request status

  • Condition

  • Other relevant characteristics

SUR may rely on information, measurements, photographs, and records supplied by the Artist or Seller.

Artwork is inherently visual, and its appearance may vary depending on:

  • Photography

  • Lighting

  • Screen settings

  • Display calibration

  • Framing

  • Surrounding conditions

Minor differences between the digital image and the physical artwork will not normally be considered a defect.

Dimensions and other information may be approximate unless expressly confirmed in writing.

You should request clarification before proceeding where a particular colour, dimension, material, condition, frame, certificate, or characteristic is important to your decision.


7. Artwork Availability

All artworks are subject to availability.

An artwork may remain visible on the website after it has been:

  • Reserved

  • Sold

  • Withdrawn

  • Temporarily unavailable

  • Removed from sale

  • Made subject to another offer

SUR may correct availability information, descriptions, pricing, or website errors at any time.

An inquiry or request to purchase does not reserve an artwork unless the Artist, Seller, or SUR confirms the reservation in writing.


8. Artwork Inquiries

Visitors may contact SUR to ask about:

  • Artwork availability

  • Price

  • Artist information

  • Condition

  • Dimensions

  • Materials

  • Authenticity documents

  • Delivery

  • Collection

  • Other transaction details

Submitting an inquiry, order request, or expression of interest does not automatically create a binding transaction.

SUR will communicate with the relevant Artist or Seller to confirm the information required to proceed.


9. Identification of the Artist or Seller

Before payment is requested, the Buyer will be informed of the relevant details of the Artist or Seller receiving the payment.

The Seller may be:

  • The artist who created the artwork

  • The current lawful owner of the artwork

  • An authorised representative of the artist

  • Another person or entity legally entitled to sell the artwork

The Buyer should not transfer payment until the Seller’s details, final price, and payment instructions have been confirmed through an authorised communication.


10. Formation of the Sales Agreement

A sales agreement is formed directly between the Buyer and the Artist or Seller when:

  1. The Artist or Seller confirms that the artwork is available.

  2. The final price, delivery arrangements, and material transaction terms have been communicated.

  3. The Buyer agrees to those terms.

  4. The required payment is received by the Artist or Seller in cleared funds.

  5. The transaction is confirmed in writing.

SUR may communicate confirmations on behalf of the Artist or Seller for administrative purposes.

Such communication does not make SUR the Seller or payment recipient.


11. Prices and Currency

Prices may be displayed on the website or provided following an inquiry.

Unless expressly stated otherwise:

  • Prices relate only to the artwork

  • Delivery may be charged separately

  • Packaging may be charged separately

  • Shipping insurance may be charged separately

  • Customs duties and import taxes may apply

  • Installation may be charged separately

  • Bank charges may apply

  • Currency-conversion charges may apply

  • Prices may change before a transaction is confirmed

  • A displayed price does not guarantee availability

The final price, currency, and applicable additional costs will be confirmed before payment.

Where the Artist or Seller changes the price before accepting the transaction, the Buyer may decide whether to proceed.

No price change may be imposed after the Buyer and Seller have formed a binding sales agreement unless they both agree.


12. Bank-Transfer Payments

SUR does not accept credit-card or debit-card payments through the website.

Unless expressly stated otherwise, all artwork payments are made by bank transfer directly to the Artist or Seller.

SUR does not receive, hold, control, or process the purchase funds.

The Buyer is responsible for:

  • Confirming the payment recipient’s identity

  • Using the correct bank details

  • Including any required transfer reference

  • Paying applicable bank or transfer charges

  • Ensuring that the full agreed amount is received

  • Verifying any unexpected change to payment instructions before transferring money

The Artist or Seller is responsible for confirming receipt of payment.

The Buyer should not send payment to an account merely because it appears in an unexpected email, message, attachment, or communication.

Any unexpected change to bank details should be verified through a separate authorised communication channel.

SUR is not responsible for money transferred to fraudulent, unauthorised, or incorrect bank details that were not genuinely supplied or confirmed by SUR or the relevant Artist or Seller.


13. Reservations

An Artist or Seller may agree to reserve an artwork for a limited period.

A reservation is only valid where confirmed in writing and may be subject to:

  • A deposit

  • A payment deadline

  • A reservation deadline

  • Other conditions

If payment is not received by the agreed deadline, the Artist or Seller may release the artwork without further obligation.

Any deposit terms, including whether the deposit is refundable or non-refundable, will be communicated before payment.


14. Artwork Ownership and Authority to Sell

The Artist or Seller is responsible for confirming that they:

  • Own the artwork or are authorised to sell it

  • Have the right to transfer physical ownership

  • Have accurately disclosed relevant ownership restrictions

  • Have provided materially accurate information

  • Are entitled to receive the payment

  • Have disclosed any known material condition issue

SUR relies on information provided by artists, artwork owners, and authorised representatives.

SUR may perform reasonable checks but does not provide an absolute guarantee of:

  • Ownership

  • Title

  • Provenance

  • Authenticity

  • Attribution

  • Seller authority

Any specific guarantee must be expressly provided in writing.

Nothing in these Terms removes responsibility arising from SUR’s own fraud, deliberate misrepresentation, or liability that cannot legally be excluded.


15. Authenticity and Documentation

Where an artwork is accompanied by a certificate of authenticity, provenance record, artist documentation, edition information, or other supporting material, this will be communicated where available.

The absence of a certificate does not by itself mean that an artwork is not authentic, particularly where the artist does not ordinarily issue certificates.

You should ask before payment where a certificate, signature, provenance record, edition number, or other document is essential to your decision.

Unless expressly stated otherwise, neither SUR nor the Artist provides:

  • An independent financial valuation

  • An investment guarantee

  • A prediction of future value

  • A guarantee of resale value

16. Delivery and Collection

Delivery or collection arrangements will be agreed separately for each transaction.

The Artist or Seller is responsible for making the artwork available for the agreed delivery or collection arrangement.

SUR may assist in coordinating:

  • Packaging

  • Courier quotations

  • Collection times

  • Shipping documents

  • Communication between the Buyer, Artist, and delivery provider

The party responsible for delivery costs, insurance, customs, risk, and handling will be confirmed before payment.

Estimated delivery dates are estimates only unless a fixed date is expressly agreed in writing.

Delivery may be affected by:

  • Artwork location

  • Artist availability

  • Packaging requirements

  • Courier schedules

  • Customs clearance

  • Weather

  • Public holidays

  • Import restrictions

  • Events outside reasonable control

The Buyer is responsible for providing complete and accurate delivery details.

Additional costs caused by inaccurate information, failed delivery attempts, refusal to accept delivery, or failure to collect may be charged to the Buyer.


17. Shipping, Customs, and Import Charges

Where an artwork is delivered internationally or across customs boundaries, additional costs may apply, including:

  • Customs duties

  • Import taxes

  • Clearance fees

  • Storage charges

  • Inspection fees

  • Permit fees

  • Courier administration charges

Unless expressly agreed otherwise, the Buyer is responsible for understanding and paying charges imposed in the destination country.


SUR and the Artist may provide available information but do not guarantee customs clearance or advise on the laws of every destination.


18. Risk During Delivery

Responsibility for loss or damage during delivery will depend on the delivery arrangement agreed between the Buyer and Artist or Seller.

Where the Buyer contracts and pays a courier directly, the courier agreement is between the Buyer and that courier.

Where the Artist or Seller contracts the courier, the Artist or Seller is responsible for communicating the applicable delivery and insurance arrangements.

SUR’s assistance with delivery coordination does not make SUR:

  • The courier

  • The carrier

  • The exporter

  • The importer

  • The insurer

  • The party responsible for physical delivery

19. Inspection and Delivery Issues

The Buyer should inspect the artwork and packaging as soon as reasonably possible after delivery.

Any apparent damage, incorrect artwork, or material discrepancy should be reported promptly to SUR and the Artist or Seller.

The Buyer should provide:

  • Their name

  • Artwork and transaction details

  • A description of the issue

  • Photographs of the artwork

  • Photographs of the internal packaging

  • Photographs of the external packaging

  • Courier or delivery documentation

  • Any other reasonably requested evidence

The Buyer should retain the artwork and all packaging while the issue is reviewed.

The Buyer should not arrange repairs, disposal, or return shipment without first receiving instructions from the Artist, Seller, or SUR.

SUR may assist the parties in communicating and reviewing the issue but does not guarantee the outcome of a dispute.


20. Cancellations

The applicable cancellation terms will be communicated before the transaction is confirmed.

A cancellation request may be refused where:

  • Payment has already been completed

  • The artwork has been removed from sale

  • Packaging or shipping has begun

  • The artwork was commissioned

  • The artwork was personalised

  • The artwork was altered or framed for the Buyer

  • The artwork was made to order

  • The artwork was specially sourced

  • Costs have already been incurred

Nothing in these Terms excludes a cancellation right that cannot legally be excluded.


21. Returns

The applicable return terms will depend on the artwork and transaction.

Unless the Artist or Seller confirms otherwise in writing before payment, a change of mind does not automatically create a right to return an artwork.

The Artist or Seller will review return requests where:

  • The incorrect artwork was delivered

  • The artwork was materially damaged before delivery

  • The artwork materially differs from its confirmed written description

  • A return right applies under mandatory law

  • A return right was agreed before the transaction

Any approved return must follow the Artist’s or Seller’s instructions and use suitable packaging, handling, and transportation.

Commissioned, personalised, altered, framed-to-order, made-to-order, and specially sourced artworks are generally not returnable for change of mind once work or sourcing has begun.


22. Refunds

The Artist or Seller who received the payment is responsible for accepting, refusing, and administering any refund, subject to:

  • The agreed transaction terms

  • Applicable law

  • The circumstances of the complaint

  • The condition of the returned artwork

SUR may assist with communication but is not responsible for refunding money it did not receive.

Where a refund is approved, it will normally be returned by bank transfer to the person or account from which payment was received.

The Artist or Seller may request information reasonably necessary to verify the recipient and process the transfer.

Unless required otherwise by applicable law, the following may be excluded or deducted where they were not caused by the Artist or Seller:

  • Bank charges

  • Currency-conversion losses

  • Delivery charges

  • Customs charges

  • Packaging costs

  • Other third-party expenses

The time required for a refund to appear may depend on the banks and countries involved.


23. Disputes Between the Buyer and Artist

The Buyer and Artist or Seller should first attempt to resolve any disagreement through direct and good-faith communication.

SUR may voluntarily assist by:

  • Sharing transaction records

  • Clarifying communications

  • Facilitating discussions

  • Requesting supporting documents

  • Helping the parties explore a practical solution

SUR is not required to act as:

  • An arbitrator

  • A court

  • An insurer

  • A payment guarantor

  • A legal representative

  • An escrow provider

Any assistance provided by SUR does not make SUR financially responsible for the Buyer’s or Seller’s obligations.


24. Fees or Commission Paid to SUR

SUR may receive a commission, referral fee, listing fee, promotional fee, or other compensation from the Artist or Seller for services provided by SUR.

Unless expressly communicated otherwise, any arrangement between SUR and the Artist or Seller is separate from the Buyer’s payment obligations.

The Buyer pays the agreed artwork price directly to the Artist or Seller.

The Artist or Seller remains responsible for any separate amount owed to SUR.

SUR’s receipt of a commission or fee does not make SUR the owner or Seller of the artwork.


25. Intellectual Property

The website and its content may include:

  • Artworks

  • Artwork photographs

  • Videos

  • Artist biographies

  • Text

  • Graphics

  • Layouts

  • Logos

  • Branding

  • Other protected materials

These materials may be protected by copyright, trademark, moral rights, and other intellectual-property rights.

Ownership of a physical artwork does not automatically transfer copyright or other intellectual-property rights in that artwork.

Unless expressly agreed in writing, purchasing an artwork gives the Buyer ownership of the physical work only.

It does not give the Buyer the right to:

  • Reproduce the artwork commercially

  • Create or sell copies

  • Use the artwork as a logo or brand asset

  • Create merchandise based on the artwork

  • Publish the artwork for commercial advertising

  • Mint or tokenise a digital representation

  • Commercially exploit a digital representation

  • Remove the artist’s name

  • Falsely attribute the artwork

  • Modify the artwork in a way that infringes the artist’s rights

Website content may not be copied, republished, modified, distributed, scraped, or commercially used without permission from the relevant rights holder.

Reasonable personal and non-commercial sharing may be permitted where the artist and SUR are appropriately credited and the use does not misrepresent or exploit the work.


26. Artist and Third-Party Rights

Certain artworks and content are provided by artists, owners, or other rights holders.

SUR does not claim ownership of rights belonging to artists or third parties.

Artist names, biographies, artwork images, and related materials may not be used in a manner suggesting endorsement, partnership, representation, or authorisation without permission.


27. Submissions to SUR

Where you send SUR artwork, portfolios, photographs, proposals, biographies, or other materials, you confirm that:

  • You are entitled to submit the material

  • The material does not knowingly infringe another person’s rights

  • The information provided is reasonably accurate

  • SUR may review and internally share the submission for evaluation

Submitting material does not require SUR to:

  • Display the material

  • Represent the artist

  • Sell the artwork

  • Promote the artist

  • Purchase the artwork

  • Respond to the submission

SUR will not commercially publish submitted artwork without appropriate permission.

You should not send confidential commercial information unless confidentiality has been agreed in writing beforehand.


28. Acceptable Website Use

You must not:

  • Use the website unlawfully

  • Attempt to gain unauthorised access

  • Introduce malicious software

  • Interfere with website operation

  • Scrape or systematically extract website content without permission

  • Impersonate another person

  • Submit false identity or payment information

  • Harass an artist, buyer, or SUR representative

  • Use artwork information in an infringing or misleading manner

  • Attempt to bypass SUR to avoid agreed fees or commissions where you are contractually bound not to do so

SUR may restrict access or decline communications where misuse, fraud, harassment, or unlawful activity is suspected.


29. Third-Party Websites

The website may contain links to artist websites, social-media platforms, galleries, payment services, or other third-party services.

SUR does not control and is not responsible for:

  • Third-party content

  • Availability

  • Transactions

  • Security

  • Privacy practices

  • Accuracy

  • Products or services

You use third-party websites at your own discretion.


30. Website Availability

SUR does not guarantee that the website will always be:

  • Available

  • Uninterrupted

  • Error-free

  • Accurate

  • Free from harmful components

The website may be suspended, modified, or withdrawn for maintenance, technical, security, operational, or other reasons.

SUR may change website content, artwork listings, and features without notice.


31. Limitation of Responsibility

SUR will take reasonable care when facilitating artwork inquiries and communications.

To the extent permitted by applicable law, SUR is not responsible for:

  • An Artist’s failure to complete a sale

  • An Artist’s failure to deliver

  • An Artist’s refusal to refund

  • Incorrect information supplied by an Artist

  • An Artist’s lack of ownership or authority

  • Damage caused by a third-party courier

  • Customs delays

  • Bank-transfer delays

  • Currency losses

  • Indirect or consequential losses

  • Loss of opportunity

  • Changes in artwork market value

  • Third-party services

  • Website interruption

SUR’s responsibility, where established, will ordinarily be limited to the amount of any commission or fee actually received by SUR in connection with the affected transaction.


Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud or deliberate misconduct.


32. Events Outside Reasonable Control

SUR will not be responsible for delay or failure caused by circumstances outside its reasonable control, including:

  • Transportation disruption

  • Customs delays

  • Government action

  • Conflict

  • Natural events

  • Internet failure

  • Hosting failure

  • Banking disruption

  • Labour disputes

  • Courier delays

  • Artist illness or unavailability

  • Import or export restrictions

SUR will make reasonable efforts to communicate material delays and assist the parties in identifying a practical solution.


33. Privacy

Personal information is handled according to SUR’s Privacy Policy.

The Privacy Policy forms part of these Terms and Conditions.


34. Changes to These Terms

SUR may update these Terms and Conditions from time to time.

The current version will be published on the website with the latest revision date.

The terms applicable to an artwork transaction will generally be those communicated or published when the transaction is confirmed, unless:

  • A change is required by law

  • The Buyer and Seller agree otherwise

  • The change benefits the Buyer without reducing an existing right

35. Governing Law and Disputes

These Terms and Conditions and SUR’s role in facilitating artwork transactions are governed by the laws of the Hashemite Kingdom of Jordan, unless mandatory law requires otherwise.

The Buyer, Artist, Seller, and SUR should first attempt to resolve any dispute through direct and good-faith communication.

Where a dispute involving SUR cannot be resolved directly, it may be submitted to the competent courts of Jordan, subject to any mandatory consumer right or jurisdiction that cannot legally be excluded.

A dispute concerning the sale itself may also be governed by the separate agreement between the Buyer and Artist or Seller.
